The government recently announced that the implementation of the IR35 tax reforms are to be deferred until 6th April 2021, a move prompted by the disruption caused by the Coronavirus.
However, it would be imprudent to no longer view IR35 as a priority. Rather the delay should be seen by contractors, agencies and HR departments as an opportunity to fully engage and understand the issues the reforms will bring. Now is the time to evaluate all available options in a comprehensive and measured way.
Are you an agency looking to outsource compliance? Are you a client engaging limited company contractors through their personal service companies (“PSC”)? Are you confident that you fully understand and are complying and are prepared to comply with the new rules which require you to meet the “reasonable care” threshold set by HMRC? Have you updated your contracts to flow down the new obligations to your sub-contractors?
IR35 is not just a tax issue. Rooted in compliance and employment law, it is primarily a legal one. At WTT, we have dedicated legal team, led by Carla Roberts who is a highly experienced IR35 expert.
